Attention property managers: new Wki rules as of October 1
As of tomorrow, October 1, 2026, Article 18 of the Debt Collection Services Quality Act (Wki) comes into effect.
The core issue: if rent arrears are collected by a party not listed in the Debt Collection Services Register, the collection costs will be waived and interest will cease. A bailiff or lawyer who takes over the case later will also no longer be able to charge those costs. The rent debt itself, however, remains due.
For landlords and property managers, the distinction is important:
- Owner sending reminders to their own tenants? Then you are not subject to the registration requirement for this.
- Manager collecting on behalf of an owner? Then the Wki does apply, certainly for tenants who are natural persons (including sole proprietorships and general partnership partners)
Additionally, as of October 1, the Judiciary will require the names and registration numbers of all involved collection parties in summonses. If this information is missing, the judge will reject the claim for costs and interest. Our advice: record who took which steps per property and tenant. emlinked automatically and audit-proof records exactly that in your property management administration.
